Health & AI Disclaimer
Summary
- Five to Nine helps you plan your time. It is not a doctor, dietitian, nutritionist or personal trainer, and nothing in it is medical advice.
- Day plans, workouts and recipes are created by AI. No human expert checks them, and they can be wrong, incomplete or unsuitable for you.
- Talk to a doctor before you start a new exercise or eating routine, especially if you are pregnant, have a medical condition, take medication, have an injury, or have a history of disordered eating.
- Stop exercising straight away if you feel pain, dizziness, chest discomfort or shortness of breath.
- If you have a food allergy or intolerance, check every ingredient yourself. AI can miss allergens.
- Five to Nine is not for emergencies. If you need urgent help, call your local emergency number.
This disclaimer is part of our Terms of Service. "We", "us" and "our" mean Ricardo Pedrotti Vespero Fernandes, the provider of the Five to Nine app ("Five to Nine" or "the app"). "You" means the person using the app.
1. What Five to Nine is, and what it isn't
Five to Nine is a planning tool for the time outside your working hours. It can suggest day plans, workout routines, recipes, habits and grocery lists, and lets you track what you do.
Everything the app shows you is general information and suggestions, provided for planning and motivation. It is not medical, nutritional, dietetic, psychological, fitness or other professional advice. Using the app does not create a doctor-patient, dietitian-client, trainer-client or any other professional relationship between you and us.
The app does not diagnose, treat, cure or prevent any disease or condition, and it is not a medical device. Never ignore professional advice, or delay seeking it, because of something you saw in Five to Nine. If professional advice differs from the app, follow the professional.
2. AI-generated content
Many suggestions in Five to Nine are created by artificial intelligence (AI) models run by third-party providers (listed in our Privacy Policy). This includes day plans, workout routines, recipes, ingredient lists, and the information we read from photos of your receipts.
- It can be wrong. AI output can be inaccurate, incomplete, out of date, or simply made up, even when it sounds confident.
- No human expert reviews it. We do not check individual AI suggestions before you see them.
- It only knows what you tell it. The AI does not know your medical history, fitness level, injuries or allergies unless you enter them, and even then it may not take them into account correctly. Incomplete or incorrect input leads to unsuitable suggestions.
- You decide. Treat every AI suggestion as a starting point. Use your own judgement, and get professional advice where it matters, before you act on it.
We label AI-generated content in the app so you can tell it apart from content you created yourself.
3. Exercise and physical activity
Physical activity carries a risk of injury, and in rare cases serious harm. Workout routines in Five to Nine are general suggestions for healthy adults. They are not tailored by a professional to your body, health or abilities.
Check with a doctor first
Speak to a doctor or other qualified health professional before starting a new exercise routine or significantly increasing your activity, especially if you:
- are pregnant, may be pregnant, or have recently given birth;
- have a heart, lung, joint, bone, metabolic or other medical condition, or high blood pressure;
- take medication that affects your heart rate, blood pressure, balance or energy;
- have a current or past injury, or have had surgery;
- have not exercised in a long time, or are new to a type of exercise.
Listen to your body
Stop immediately and seek medical help if you feel pain, faintness, dizziness, chest pain or pressure, an irregular heartbeat, or severe shortness of breath. Warm up, use proper form and suitable equipment, start with loads you can control, and use a spotter for heavy lifts. Weights, reps, durations and effort levels in the app are suggestions; adjust them to what is safe for you.
Your responsibility
You choose whether, how and where you exercise. To the extent permitted by law, you take responsibility for the risks of the physical activities you choose to do. Nothing in this disclaimer limits any rights you have under consumer law, or any liability that cannot be limited by law (see our Terms of Service).
4. Food, recipes and nutrition
Allergies and intolerances
Recipes, ingredient lists and suggestions may not mention every allergen, and AI can make mistakes when it considers your dietary preferences. If you or anyone you cook for has a food allergy or intolerance, read every ingredient and product label yourself before cooking or eating. Never rely on the app alone to decide that food is safe for someone with an allergy.
Food safety
You are responsible for preparing, cooking and storing food safely, including cooking temperatures and times, hygiene and cross-contamination. Recipe timings are estimates.
Pantry, groceries and receipts
Expiry dates and freshness information in your pantry are reminders only; always check the food itself and its packaging. Information read from receipt photos (item names, quantities, prices) may be inaccurate, so check it before relying on it.
Nutrition and special diets
Any nutrition, portion or calorie information is an estimate. Five to Nine does not provide medical nutrition therapy and is not designed for managing conditions such as diabetes, kidney disease, coeliac disease or food allergies. If you follow a diet for medical reasons, are pregnant or breastfeeding, or want to change your weight, get advice from a doctor or registered dietitian.
If you have, or have had, an eating disorder, please talk to a health professional before using meal planning or tracking features, and stop using them if they make you feel worse.
5. Wellbeing and habits
Habit streaks, reminders and scores are there to help you build routines. They are not a measure of your health or worth. If you are struggling with your mental health, please reach out to a health professional or a local support service. Five to Nine cannot respond to a crisis. In an emergency, call your local emergency number.
6. Who can use Five to Nine
You must be at least 18 years old to use Five to Nine. The app is not designed for children.
7. Changes to this disclaimer
We may update this disclaimer as the app changes. When we make a significant change, we will tell you in the app before it takes effect. The version and effective date at the top show which version applies.
